I do not want to bow before corruption

I live in a flat in secunderabad cantonment area. I and my flat neighbors are paying property tax since almost ten years. But we are unable to register our name as owners of the flat in the property tax department inspite of repeated applications being submitted.  There are brokers who are offering to get the job done if we pay Rs.10,000. Is there any other way without giving in to corrupt officers.

I believe the Right To Information act can be put to good use for this purpose.

Submit an application for regstering your flat. Make sure you have a xerox copy and a signed copy of the receipt.
Let us say no response for a month. You can actually use the RTI act to ask for details on why they have not acted on your application. I believe RTI makes it mandatory for them to respond to your query.

There are also Ombudsman located for RTI in every area, who can help you with that process and you can complain to the ombudsman if they do not respond to RTI. The government empowers you with this. This is one of the foremost tools against corruption available to the common citizen.

I also believe just because you enquired through RTI, they cannot victimize you. There are safeguards built in. Check with the ombudsman on this.

If all these do not work, may be  "Gandhigiri" can be tried.
a) Send flowers to the concerned officer for four weeks (one day a week) with a note to approve your application
b) may be others can suggest on alternatives ?

how can they accept property tax from anyone if its not owned by anyone? its the same department innit?

The flats are in the name of the builder. The tax deptt is taking our cheques but giving the reciepts in the name of the builder. We want in our  name since the flats are registered in our name.

Ok....then try this....

If they want YOU to pay the taxes, ask them to send the Tax bill/notice/reciept to YOU in your name.  Ask them if they would pay electricity bill in someone else's name but delivered to their house.

Also, what happens if you don't pay.  The Tax dept. will have to take follow -up action, reminders, notice, eviction notice, blah blah.... but why do YOU care...all those will be in the builder's name.  Keep avoiding them all UNTIL something shows up in YOUR name...

I think you have a lot going and you can make the builder, Tax dept. and everyone else if ONLY you patiently outdodge them...

Story time: When I wanted to change the house ownership, went to the registrar's office... and the guy told me to come the next day.. I said I had nothing better to do and will wait. I waited and waited sitting infront of the clerk of the clerk of the clerk of the regitrar. read everything I can find... and he tried to stay away from his own desk to avoid me... whenever he showed up I asked him about the court papers on his desk... lunch came and went - but Uppili was still there. Finally, I was not going anywhere and he gave what I wanted at 3 PM. Even then I wanted an English translation duly signed.  one was prepared, typed, and signed in 30 min....;)  bcz they did not want Uppili to sit in the closed office all night... 

I know as a woman you cannot do it. BUT, IF THEY EVEN SUSPECT THAT YOU JUST MIGHT DO SUCH A THING, they will approve your papers in no time.  It is all about mind game..... Until they themselves end up in a pressure situation. Create one and put them in it. 

STOP PAYING/responding unless you get a notice/bill in YOUR name.

I appreciate your courage to not to bow before corruption, but then you will have to spent double the money they are asking in bribe.
lawyers fees, your travelling expenses, days spending at Govt. offices which will go unpaid if you are working person, mental tension you give to urself and your immediate family who must be knowing of all this........
better pay Rs.10000 and live in peace....

Now Don't do what I said above if everyone will do that then who will change the country...
You are the son of soil... take a torch and lead us.... we will be thankful to you...

You could try http://pgportal.gov.in/index.html  to register you complaint and follow up. But not sure how the repurcussions of complaining :) 

I did register a grievance  (not on a similar issue but something related to Telephones department), months ago, and it was solved within reasonable timeframe wihout any additional effort on my part.  Remember I did it thru only one email sitting faaaar away:)

Thank you...

From now on I will be lodging a complaint as and when I feel bored... Starting with one against my neighbors who all have built a 3 storey structure on a street that cannot have any structure more than 1 floor.  This has diminished the attractiveness of my house and hence the govt. should immediately bulldoze the illegal structures of my neighbors.

Get hold of a good lawyer who deals with Real estate issues. 

Apply OFFICIALLY to the Tax department or enquiring your previous pending application by REGISTERED POST with a copy to the district collector, clearly stating that without this ownership issue being resolved legally, you will be unable to pay property taxes as it will seem contradictory and only appears to encourage the misguided policies of the property tax department. 

This letter and the copy should be sent by a lawyer representing YOU AND ALL YOUR AFFECTED neighbors.
Deal everything in writing... This is basicaly american way of handling things but I will gve it a shot in India also just to see of the "new India" and its structure will respond differently at least now.

Moral:  All paper work MUST BE settled before paying up the final installment for any purchase of a flat. Just like they hold the agreement against you, you also hold it against them.

Of course, these are pretty well established these days and as most purchases involve bank loans, the BANK will demand proper ownership documentation even if you dont ask. You happen to purchase it at the dawn of the golden era.

So lemme guess.. you bought a flat for 6 Laks and it is now close 1 crore....:))))

Your problem is the property tax department and not the corrupt 'officers' asking you for money. Talk to your CM about it if there are many of you facing the same problem.

I understand Chiranjeevi is going to be  the next CM of Andhra Pradesh.  If possible cultivate his friendship and try to settle this matter before he becomes the CM.  I am going through the very same trauma in Tamilnadu on behalf of the people for whom I work.  

The I.A.S Officer who heads the department is very young and naive .  And to add to my bag of worries he is a North Indian, not used to the devious mentalities of South Indians.   The Corporation Property Tax department has put forward all their demands on the internet and to the top officials that is transpaent enough.   What one has to do is to download those demands fill-in the blank spaces and sign it and submit to the Commissioner who will sign it even without reading it.  You end up paying the tax.  As simple as that.   But this puts the minions out of their earnings.  They would visit your residence and teach you ways and means of defrauding th Government of its righful dues of course for a consideration.  

You may convert part of the property into commercial, part of it into residential,  part as common area and part as unused.  Till the next assessment a lot of juggleries are possible.  At the end of the day you end up paying the same amount of money, obviously much less to the government and a major portion to the intermediaries who fawn on you and suck your meagre earnings like a sponge.  

Unfortunately no body understands the rules of the tax department which were framed by the British to favour the King/Queen of England, I mean their rule in India.  Since our politicians found the obfuscating rules to their advantage they let it stand on the statute books once in a while adding some other inanities so that it confuses the citizen further. 

All things said and done you are at the loser's end.  Even Paramatma would be helpless against the machinations and chicanery of the devious minds of the Indian Babus in general and South of the Vindhyas in particular.  

I am a free bird, as I do not own a square inch of land in Mother India.  

You need God's blessings, and if it comes in the form of Chiranjeevi, so be it.
